Terms of Use

1. Mission Agreement (Acceptance)

Welcome to the Kompul ecosystem. These Terms of Use ("Terms") govern your access and use of all our platforms, including:

  • The main web application (app.kompul.com)
  • The showcase website (kompul.com)
  • The educational blog (survivebackpacking.com)
  • All artificial intelligence services and related content (collectively, the "Service").

The Service is owned and operated by Janara Nguon, operating under the name Kompul ("Kompul", "we", "our"). By accessing the Service, you agree to be bound by these Terms. If you do not agree, you may not access the Service.

2. Nature of Service (Disclaimer)

Kompul is a technological organization tool, not a financial advisor.

No Professional Advice:

The Service provides tracking tools, behavioral analyses, and general information. It does not provide any professional advice regarding investment, taxation, or law.

Your Responsibility:

You are the sole "Commander" of your financial decisions. The use of calculators, projections, or AI suggestions is at your own risk.

Consult Professionals:

Before making major decisions, consult a financial planner or certified accountant (CPA).

3. Artificial Intelligence (AI Coach & Detector)

The Service integrates artificial intelligence technologies (including Google's Gemini) to provide analyses. By using these features, you acknowledge that:

Error Risk:

AI may generate incorrect information ("hallucinations"). You must always verify calculations manually.

No Human:

Responses are generated by algorithms, without human intervention or validation.

No Liability:

Kompul is not responsible for financial losses resulting from an action taken based on an AI suggestion.

4. Accounts and Authorized Use

Fortress Security:

You are responsible for protecting your credentials (Password, Passkeys). Any action performed from your account is deemed to be yours.

Personal vs Commercial Use:

Standard Users: You agree to use the Service solely for personal and private purposes.

Coaches & Pros: Commercial use is permitted only for holders of an active "Kompul Pro" or "Coach" subscription, in the context of supporting their own clients.

Prohibitions:

It is prohibited to attempt to hack the service, extract data (scraping), or use AI to generate illegal or fraudulent content.

5. Subscriptions and Payments

Billing:

Subscriptions (Climber Plan, Operator, Pro) are billed in advance. The price is that displayed at the time of purchase.

The Founders Circle:

This limited offer guarantees the locking of the monthly price (e.g., $2.99 CAD) as long as the subscription remains active without interruption. In case of cancellation or payment default, the frozen price privilege is permanently lost.

Renewal:

The subscription automatically renews at the end of each period.

Cancellation:

You may cancel at any time via your dashboard. Access continues until the end of the paid period. No refund is granted for unused partial months.

6. Intellectual Property (The Arsenal)

The Service, its source code, algorithms, "Gamified" texts (Recruit, Operator, etc.), and its brand are the exclusive property of Kompul.

License:

We grant you a limited, non-exclusive, and revocable license to use the application.

Prohibition:

You may not copy, modify, distribute, or reverse engineer our software.

7. Limitation of Liability

To the maximum extent permitted by Quebec law: Kompul shall in no event be liable for indirect damages, financial losses, loss of profits, or data loss resulting from your use of the Service, a Service failure, or an AI error. Our total liability is limited to the amount you have paid us over the past 12 months.

8. Data Protection (Law 25)

We take privacy seriously. Your data is processed in accordance with our Privacy Policy. By using the Service, you consent to the storage of your data on secure servers (Google Cloud/Firebase), potentially located outside your province of residence.

9. Termination

We reserve the right to suspend your account immediately and without notice in case of violation of these Terms (e.g., fraud, abusive account sharing).

10. Applicable Law

These Terms are governed by the laws of the Province of Quebec, Canada. Any dispute will be subject to the exclusive jurisdiction of the courts of the judicial district of Quebec.
